Overview of the Sexual Abuse Lawsuit Investigation Against Manhattan Urologist Darius Paduch

After being charged by a jury on four charges of unlawful sexual activity, the Federal Bureau of Investigation detained Dr. Darius Paduch on April 11, 2023.

He faces criminal charges after years of sexually abusing his patients.

The indictment outlines how Paduch sexually abused patients at prominent medical institutions in New York.

Paduch pretended to provide medical treatment to his victims, conducting purported urological examinations, but was assaulting them sexually for his own deviant satisfaction.

Trigger Warning: Description of sexually abusive behavior.

Paduch would sexually abuse patients using the largely same tactics.

Without providing a legitimate medical reason, he played pornographic media for his victims, instructed victims to masturbate in his presence, touched their genitalia without warning or gloves, insisted on masturbating them himself or stimulating them with a vibrating instrument, and urged them to orgasm and ejaculate in his presence.

In addition, Paduch frequently inserted his fingers into patients’ rectums for no medical reason and without gloves.

During these sessions, he was often close to his victims and they could see he was sexually aroused.

Paduch also made inappropriate and sexual comments, such as offering details about his own sexual behavior to his victims and starting discussions about his victims’ sexual activity, physique, and appearance.

After committing criminal sexual acts, he would set up appointments for his victims, give them his mobile phone number, and pressure them to come back to see him.

Institutions Enabled Darius Paduch to Sexually Abuse Patients

Medical professionals are ethically obliged to put their patient’s health and safety first throughout their medical career.

New York Presbyterian has a long history of prioritizing its own image over the safety of its patients, and this is only the latest example of this.

Many male reproductive health patients went to the hospital without realizing they were being treated by serial sexual offenders.

Employers of medical professionals in New York must guarantee the safety of their patients and students while they are receiving care for sensitive medical problems or attending classes there.

This implies that if an employee who was known or should have been known to constitute a threat to patients commits a crime that results in injury, the employer must be held liable.

Darius Paduch’s sexual abuse survivors reported their experiences to police and relevant agencies.

The New York Department of Health was aware that Paduch repeatedly abused patients five years before his arrest.

Where Did Darius Paduch Work?

According to the statement released by the Department of Justice, Darius Paduch worked at several prominent medical institutions in and around New York.

The institutions that employed Darius Paduch include:

  • New York Presbyterian Hospital
  • Northwell Health
  • Weill Cornell Medical Center

Abuse Survivors Speak Out About Dr. Darius Paduch

The claims of sexual assault against Dr. Darius Paduch are not new, nor are they expected to end with his indictment in April.

In the early months of 2023, numerous survivors took legal action against NY Presbyterian and Northwell Health, claiming that they were victims of abuse at the hands of Paduch while under their care as patients or interns.

The lawsuits claim that these institutions failed to fulfill their duty to protect individuals from such abuse.

Both NY Presbyterian and Northwell Health have vehemently denied any prior knowledge of Paduch’s assaults on patients, indicating they do not accept liability for his actions.

Nonetheless, the plaintiffs in these lawsuits seek access to documents and other evidence that could potentially demonstrate negligence on the part of the medical institutions in either the hiring or supervision of Paduch or their failure to ensure patient safety.

The initiation of civil suits and the subsequent criminal charges against Paduch has had a ripple effect, prompting an increasing number of additional survivors to come forward with their own accounts of abuse.

These survivors are now pursuing claims against NY Presbyterian, Weill Cornell Medicine and Northwell Health, seeking damages for the various emotional injuries they have endured, including anxiety, depression, post-traumatic stress disorder (PTSD), sexual dysfunction, and other related trauma.

The ability for these survivors to pursue legal recourse against Paduch, whose history of abuse is suspected to span several decades, has been made possible by recent changes to New York laws.

The combined effect of these legal reforms and the courage of survivors coming forward has shed light on a pattern of abuse perpetrated by Paduch.

The ongoing legal proceedings seek not only justice for individual survivors but also accountability for the institutions involved.

It is a testament to the power of survivors’ voices and the importance of legislative measures in addressing and rectifying instances of sexual abuse.

Laws on Civil Lawsuits for Sexual Abuse in New York State

As mentioned earlier, New York State has implemented significant legal reforms to address sexual abuse and provide survivors with avenues for justice and compensation.

Understanding the laws governing civil lawsuits for sexual abuse is crucial for those seeking to pursue legal action and hold perpetrators accountable.

Here is an in-depth exploration of the essential laws in New York State on civil lawsuits for sexual abuse.

New York Adult Survivors Act and New York City Gender Motivated Violence Act

The New York Adult Survivors Act created a one-year revival window that remains open until November 24, 2023, enabling individuals to file lawsuits even if the previous statute of limitations had expired.

This law in particular helps Darius Paduch’s survivors seek legal action and compensation.

Furthermore, the New York City Gender Motivated Violence Act may also allow for civil lawsuits to be filed against serial sexual abusers.

How Can Sexual Abuse Survivors Receive Financial Compensation?

Survivors of sexual abuse face immense emotional and practical challenges as they seek justice and healing.

One crucial aspect of the legal process is pursuing damages, which aims to provide compensation for the harm suffered.

Here are the primary avenues through which survivors can seek damages for sexual abuse in civil lawsuits:

Civil Lawsuits

Survivors can initiate civil lawsuits against the perpetrators of sexual abuse.

These lawsuits aim to hold the responsible parties accountable for their actions and seek financial compensation for the harm caused.

In civil cases, survivors work with their legal representation to present evidence and demonstrate the extent of the economic and non-economic damages suffered.

Economic damages may include medical expenses, therapy costs, loss of income due to the abuse, and other tangible financial losses.

Non-economic damages encompass the pain and suffering, emotional distress, loss of enjoyment of life, and other intangible harms endured by the survivor.

The court considers these factors in determining the appropriate amount of compensation to be awarded.

Victim Compensation Programs

Certain states, including New York, have victim compensation programs designed to provide financial assistance to survivors of crime, including sexual abuse.

These programs are typically administered by state agencies and aim to support survivors by covering expenses related to medical care, counseling, lost wages, and other costs directly resulting from Paduch’s abuse.

Victim compensation programs have specific eligibility criteria and may require the survivor to cooperate with law enforcement or file a police report.

Survivors can consult with their attorney or contact local victim services organizations to learn more about the availability and requirements of victim compensation programs in their jurisdiction.
